Harry Fairclough Construction Staff Prepare Legal Action

Several former members of staff at Harry Fairclough Construction who became unemployed when the company went into administration are preparing to make Protective Award Claims, which could award each employee up to ninety days gross pay.

Harry Fairclough Construction, a civil contracts specialist and builder based on Howley Lane in Warrington which employed over 150 people, has recently appointed administrators.
The news has made employees redundant across the company’s headquarters in Warrington and its office in West Yorkshire despite the company’s turnover of £38 million last year.
Further to the news breaking, Employment Law Solicitors at Simpson Millar have started to get calls from former Harry Fairclough employees who were not properly consulted about the redundancies. This could potentially mean that all staff made redundant may be entitled to make a Protective Award claim and receive up to ninety days gross pay.
Stephen Pinder, a Partner and Employment Law Solicitor at Simpson Millar said, “This is, undoubtedly, an incredibly difficult time for the staff affected and many will be attempting to understand the news and plan their next steps.
“We have been contacted by former employees who are looking to bring claims for a Protective Award which would be paid out to those affected by redundancies where they have not properly been consulted.”
Pinder explains that a Protective Award is a payment awarded by an Employment Tribunal in cases where an employer fails to follow the correct procedure when making 20 or more redundancies and, where an Employment Tribunal finds in the favour of the employees, they will be able to access the funds paid by the UK Government Insolvency Service.
