Cardinal Shopfitting and Systems Limited went into administration on 13 July 2020, resulting in the immediate loss of 135 jobs, with the remaining 35 staff staying on to help fulfil any current contracts.

If you’ve lost your job at Cardinal because of the downturn in retail due to Coronavirus, you could make a Protective Award Claim for compensation on a No Win, No Fee basis.

Employment Law is clear. If a company wants to make their staff redundant, they have to consult staff on those redundancies and follow the correct redundancy procedures.

If they don’t, you could make a Protective Award Claim. Use our Online Eligibility Checker to see if you are entitled to make a claim, or call our Employment Law Solicitors to see if you can claim.

Am I Eligible to make a Protective Award?

There are two criteria that you need to meet to make a Protective Award Claim. They are:

  1. You were made redundant without proper consultation
  2. You worked at a location where 20 or more people were made redundant

If you meet both of these criteria, you could make a Protective Award Claim.

Information About Protective Awards

There are some important things you need to know about Protective Awards.

The first is that you don’t need to have a minimum length of service to make a claim.

The second is that the money is paid out by the government’s Insolvency Service, which we all pay into. The money is not being taken out of the already failing business.

Lastly, you can make a Protective Award Claim alone or with a group of your colleagues who have also been affected by the immediate redundancies at Cardinal Shopfitting and Systems Limited.

How to Make a Protective Award Claim

The process is simple.

Get in touch with one of our specialist Employment Law Solicitors who can tell you if you are eligible to claim, or use our Online Eligibility Checker.

Once we know that you meet the criteria to make a claim, we will:

  1. Contact the Administrators, KPMG, and get permission to make a Protective Award Claim
  2. Complete the ACAS Early Conciliation Process – this needs to be done before your claim can go to an Employment Tribunal
  3. Submit a claim to the Employment Tribunal – you’ll need to get a judgment from the Employment Tribunal to confirm that your employer did not follow the correct redundancy consultation process to make a Protective Award Claim.
  4. Apply for your Protective Award

Our Employment Solicitors can handle the whole process for you from start to finish and we’ll deal with your claim on a No Win, No Fee basis.

That means you don’t have to pay any money up front, so you don’t need to worry about finding the money to pay your legal fees.

How Much Do I Get for a Protective Award?

You could claim up to 90 days’ pay, but the Insolvency Service has capped its payments to a maximum of 8 weeks’ pay at £538 a week. That means you could get up to £4,304.

The amount you’re awarded will depend on the number of hours you work and your pay.
