Avoid Going to Court

If you cannot come to an agreement with your ex, you might be considering taking your divorce to Court. While some Courts in England and Wales are offering remote Hearings in lockdown, other Courts have adjourned Court proceedings until lockdown eases. The best way to be sure that your divorce will be finalised as soon as possible is to try and come to agreements with your ex-partner about childcare and finances mutually or through Mediation. This means you won’t have to go to Court.

One of Divorce Solicitors or Lawyers can guide you through the divorce process and work to settle your disputes so you can get your divorce ready for after coronavirus. Let’s look at some things you should consider if you and your partner have decided to separate in lockdown.

Putting the Children First

Lockdown has been a difficult time for all of us, but especially for children. If you’re worried about how your divorce will affect your children, get in touch. We can offer you practical legal advice on how you and your ex can agree on child arrangements, and we will always handle your case with the sensitivity it deserves.

We can work with you to try and come to an agreement with your ex-partner about how you’ll divide childcare before one or both of you moves out of the family home. That way you’ll be prepared to come out of lockdown knowing how your children will spend time with each of you. Government guidelines have allowed children to move between the houses of separated parents throughout lockdown, so you can be sure you’ll still be able to see your children regularly.

Our Divorce Solicitors can help you apply for a Child Arrangement Order (formerly called a Residence Order) or discuss child maintenance with you.

Moving Out During Lockdown

A big part of the divorce process is deciding who gets the family home. One of you might choose to stay in the family home whilst the other moves into a new property, or you might want to sell your family home and both start afresh in new homes.

As the housing market has opened back up, one of our Conveyancers can work remotely to help you buy a new home, or sell your old one. Our Conveyancing Solicitors can talk you through things you might need to consider when moving house during the pandemic.

Sort Out Your Finances

While your family home may be one of your largest financial assets, you may have other valuables that you’ll need to divide in your divorce. Covid-19 has had a large effect on many people’s finances, so if you’ve been affected financially by the pandemic you might be concerned about protecting your assets in your divorce.

Although lockdown has taken away some of our freedom, it has also gifted some of us with more time. You should try and use this time as a way of coming to an agreement with your partner about how you can make sure you’ll both be financially secure when your divorce is finalised.

If you can come to an agreement mutually, then our Fixed Fee Divorce option might work best for you. And if you want to finalise any financial terms you’ve put in place with your ex, our Divorce Solicitors can help you with a Fixed Fee Consent Order too. This means you’ll know exactly how much you’ll pay for your divorce, and can make sure the financial agreements you and your ex-partner have made are legally binding.

Separate Your Feelings from Decision Making

Emotions can run high during separation, and isolating with just one person can amplify those feelings even more. Some divorces are easier than others, but we understand that if you and your partner share many things it can be hard deciding who gets what.

But thinking logically and understanding one another can help the decision making process go a lot quicker and will save you the costs of Mediation or going to Court for your divorce.

Our Family Law and Divorce Solicitors are Resolution members, which means they are experts in settling disputes and reducing conflict between separating couples.

As some Courts have adjourned Hearings until lockdown eases, it’s important that you and your ex work together so that your divorce goes as smoothly as possible and you can avoid going to Court entirely. One of our Divorce Solicitors can help you deal with your ex or they can deal with your ex and/or their Solicitor directly.
