A Divorce Case Study – Client Situation
Mrs T, a highly successful career woman, contacted our Divorce Solicitors following the break-down of her 30-year marriage. She had three grown-up children with her husband. They both shared a substantial property portfolio including two flats in one of London’s prime real estate locations.
Mr T had ended their 30-year marriage in a text message. After this text, he ceased all communication with his wife and cut off all financial support to the family home and rental properties.
Mrs T was not aware that her husband had moved his new partner in one of their jointly owned exclusive London flats. This was the most valuable property by far. He then started to insist on selling the family home.
Mr T was initially completely unreasonable. He led a lavish lifestyle where his outgoings far exceeded his income. This left Mrs T to balance the family finances on the family home and rental properties.
How We Helped
This case posed several challenges which our Divorce Solicitors were able to overcome.
With so much animosity between husband and wife, getting them to agree to sit and discuss their divorce in a constructive way was difficult. Mediation failed but through careful negotiation, our Divorce Solicitors broke the deadlock and separated the various financial issues between them.
Mrs T had counselling to help her come to terms with the abrupt ending of the marriage and with some time, both parties reached an agreement through their solicitors.
Relations between them became increasingly acrimonious. This was exacerbated by the husband’s new partner.
Our Divorce Solicitors helped reach an agreement over the division of the rental properties and transfer of the family home to Mrs T. This helped them both to meet their respective housing needs.
Once negotiations were complete, we secured a Financial Remedy Order for Mrs T and averted a costly Court case. Due to Mr T’s high earnings, we made sure that he remained responsible for his extravagant spending, and insisted he paid for all the debts he had run up post-separation, and that this did not impact on the wife in any way.
