I approached Esther Salter for help in obtaining an EHCP for my daughter, who has complex health, social and educational needs. A Local Authority initially refused to issue the plan on the basis that my daughter's needs could be met through the "provisions ordinarily available within the mainstream college". I disagreed. Mrs. Salter informed me about my option to appeal the case in the Tribunal. I followed her advice and was thrilled with the outcome of the hearing, when the Tribunal ruled in my daughter's favour. I can not praise enough Mrs. Salter. She conducted herself with a great degree of professionalism and responsibility. She had a thorough knowledge of the case and would make sure to remind me of any deadline we had to meet, to answer all my questions. Esther is an Associate Solicitor in our Public Law Team, specialising in Education Law.

She has experience in areas including school exclusions, discrimination cases, and Judicial Reviews, breach of contract and education negligence claims. She has represented parents, students and local authorities in SEND First Tier Tribunal appeals.

Esther specialises in all kinds of SEND tribunal appeals with particular experience dealing with complex National Trial appeals involving health and social care issues. This includes First Tier and upper Tier SEND tribunal cases.

Esther conducts her own advocacy at the hearings, in person, or by video link and she has an excellent track record securing high-value school placements in First Tier Tribunal SEND appeals, getting life-changing social care recommendations for her clients, and helping numerous children who have been excluded, or out of school long-term back into education. She works in a collaborative and supportive way with her clients, local authority opponents, lawyers from other disciplines and experts ensuring that the child or young person’s interests are at the heart of her cases.

Esther has championed obtaining Exceptional Case Funding, a type of legal aid, which enables vulnerable clients to access representation at final hearings for SEND appeals. Prior to Esther’s successful application in February 2020, no applications had been successful, Esther has since secured this funding for numerous other vulnerable clients.

Esther has 11 years’ litigation and dispute resolution experience, having qualified in 2010. She initially specialised in defendant personal injury litigation, spending time at both Kennedys and DAC Beachcroft, but following a change of direction, she worked in-house at a large Local Authority dealing with education matters.

She has now brought this experience into her work in private practice, and Esther now manages a busy caseload of both private and publicly funded education cases.

Interests outside of work

Esther enjoys spending time with her husband and 3 children in East Sussex where she lives. She loves being outside, going for walks on the downs, or to the local beach. She enjoys cooking, eating, and making all kinds of cakes, singing for classical choirs, and her lockdown hobby of learning to play the piano.

Esther also provides advice and training for a local charity for families with disabled children and young people, as well as SEN legal advice to governors at a local school.
