What are Life Changing Injuries?
A life changing injury is any serious injury that results in permanent disability, long-term medical problems or reduced life expectancy. If you can prove that your life changing injuries are a direct result of the negligence of a third party, then you may be entitled to compensation.
Examples of life changing injuries can include:
- Birth injuries
- Brain or head injuries
- Multiple fractures
- Severe burns
- Spinal cord injury
Life Changing Injuries Compensation
The amounts of compensation awarded in catastrophic injury claims is often substantial, as shown in these case studies:
In most cases you can claim compensation for current and future loss of earnings, the cost of care, rehabilitation, treatment and other financial expenditure, as well as for the pain, suffering and loss of amenity caused by severe injuries. However, in order to make a successful claim, you’ll need to prove that your life changing injuries are a direct result of a third party’s negligence.
If we can take on your case, our Serious Injury Solicitors will gather evidence and bring in medical experts to assess your injuries and their impact on your life. With this information, we can then push for you to receive the compensation and rehabilitation support you need to help you recover without financial pressures.
In many life changing injuries compensation payouts, damages are awarded for new accommodation or adaptations to be made to home and work environments and also to cars, allowing victims to carry on with their lives as much as possible.
Will I Have to Go to Court?
In most cases, a life changing injury claim will be settled out of Court. The evidence that’s been gathered by our Solicitors and the medical experts’ reports on your injuries and its impact will usually be enough to prove the case and convince the third party’s insurer that they should pay an appropriate amount of compensation.
In life changing injury cases victims can’t afford to wait a long time for legal action to be resolved. So if and when the other side admit liability or partial liability, our Serious Injury Solicitors will push for Interim Payments of compensation to be awarded.
Interim Payments will help cover various expenditures if you can’t work, as well as pay for any private treatment, rehabilitation, physiotherapy and care you may need.
In some cases, the other party’s insurer may deny liability for the accident and your injuries, so any Interim Payment may not be possible until the case is resolved. However, we can make an application to the Court and ask a Judge to Order an insurer who doesn’t want to pay an Interim Payment.
Time Limit to Make a Claim
You have three years to make a claim for life changing injuries. The three year period runs from the date you suffered your injuries, or in certain circumstances, from three years when you first became aware of your injuries.
If you’re a family member making a life changing injuries claim on behalf of a loved one who has passed away, then you have three years from the date of their death in which to claim. If you’re claiming compensation on behalf of a child, a claim must be made within three years of the date the child reaches the age of 18.
