A Mesothelioma Claim Case Study - Client Situation
Our client was a full-time carer to his wife, who had recently had surgery to remove benign spinal tumours and was wheelchair-bound, when he began suffering shortness of breath.
He went to his GP, who referred him to the local cottage hospital for X-Ray and from there, had a referral to the main hospital, where he was diagnosed with mesothelioma, an industrial disease that can result from asbestos exposure at work.

He got in touch with our team of Industrial Disease Solicitors for a claims assessment and legal advice on claiming compensation from the employer responsible. Industrial Disease Solicitor Helen Grady agreed to take on the case and gathered details of his working history, so we could determine where and when he may have been exposed to asbestos.
Helen established that he was exposed to asbestos at work during the 1970s, when he was working in local factories where the shrink wrap tunnels were made using asbestos sheets. We also discovered that he came across asbestos-lagged pipes and asbestos lagging in the boiler house while working at another factory. We determined that our client had been exposed to asbestos while working for 3 companies.
We also arranged an independent medical assessment for our client and worked closely with a nursing care expert, so we could identify his current and future care needs and also those of his wife.
These assessments helped us work out an appropriate amount of compensation that reflected both of their needs.
Although the three defendant employers in the case didn’t admit responsibility at first, Helen secured a total compensation payment of £365,000 for our client. Helen also organised and case managed home adaptations, including a replacement low level kitchen, so that it was wheelchair-friendly. A hallway lift was also installed, along with a replacement bathroom for a walk-in shower.
The alterations to their home allowed our client and his wife to live more independently and provide some care for themselves. Our medical agency Premex also organised, paid for and set up private immunotherapy treatments, arranging scans and appointments for our client.
Our client also had a Will and Personal Injury Trust to protect the compensation so that his wife could continue receiving her state benefits and help through the Local Authority for her disabilities.
