Medical Negligence Claims v Basildon University Hospital
Our Medical Negligence Solicitors are offering a free claims assessment to maternity patients who believe they received negligent care from Basildon University Hospital.
The hospital’s maternity unit has been rated as inadequate by the Care Quality Commission (CQC), after a whistleblower raised concerns about the standard of care it provides.
The hospital had already been told to improve last year, following the death of a baby in September 2018 and a mother in February 2019. However, concerns about six new cases this year prompted the CQC to inspect the unit unannounced in June.
If you attended Basildon University Hospital’s maternity unit and have concerns about the care you received, get in touch with our Medical Negligence Solicitors.
We offer a free claims assessment, and would be happy to speak with you about your experience and how we can help you. We may be able to handle your claim on a No Win, No Fee basis - ask us for details.
How We Can Help You
If we can take on your case, a specialist Medical Negligence Solicitor will be assigned to your claim and be your main point of contact.
We’ll be sensitive to your wishes and circumstances throughout the claims process, and tailor our services to suit your specific needs. We’ll work closely with you and your family to achieve the best possible outcome, and make sure you’re kept updated throughout the claim.
At the same time, we’ll engage constructively with the NHS, working to settle claims in a non-confrontational way to secure an appropriate amount of compensation as soon as possible.
Kay Barnes, Partner and Medical Negligence Solicitor at Simpson Millar said, “The birth of a baby is a joyous and memorable event, but while most women deliver without difficulty, unfortunately some are high risk or experience complications which, if not managed safely, can result in serious injury or still birth.
“I know from my extensive experience working as a midwife before becoming a Solicitor that it’s essential that all women are properly assessed, graded and allocated to midwives and obstetricians with the skills and experience to be managed safely, to avoid injuries which can sadly sometimes be catastrophic and life-changing.”

- £575,000 Compensation for Child in Erb's Palsy Birth Injury Case
Problems at Basildon’s Maternity Unit
The CQC raised a number of concerns following an inspection of Basildon University Hospital’s maternity unit. These included:
- High-risk women being put in low risk areas to give birth
- Too many staff without the skills and experience needed to keep women safe
- Working between doctors, consultants and midwives described as “dysfunctional”
- Safety incidents not always properly graded according to the level of harm
- Care records not always being securely stored
- Inadequate foetal heart monitoring
Inspectors also found that failings highlighted following the death of a mother in 2019 hadn’t been addressed, as the same issues were identified in five subsequent incidents. The CQC said this showed the maternity unit hadn’t learned from previous incidents and “actions put in place were not embedded”.
