How Much Compensation Can I Claim for Stress at Work?

The amount of compensation you can claim for injuries suffered as a result of stress at work depends on the extent of your injuries. In the most severe cases, where there are significant financial losses, the compensation awarded could be over £100,000.

Compensation for Stress at Work

In the UK, personal injury compensation is divided into two categories – General Damages and Special Damages. In a claim for stress at work, the General Damages are for psychiatric injury.

General Damages for Psychiatric Injury

General Damages will be the compensation awarded for your pain, suffering and loss of amenity. Loss of amenity means the way in which your quality of life has been affected. Pain and suffering can be both physical and psychological.

Below are guidelines which state how much compensation should be awarded for General Damages in psychiatric injury cases. These are split into brackets, depending on the severity of the injury. For example, as a general guide:

Severe – in the most severe cases, the compensation awarded could be between £48,000 and £101,000

Moderately Severe – in moderately severe cases, the compensation awarded could be between £16,000 and £48,000

Moderate – in moderate cases, the compensation awarded could be between £5,000 and £16,000

Less Severe – in less severe cases, the compensation award could be between £1,000 and £5,000.

Special Damages for Psychiatric Injury Caused by Stress at Work

Special Damages are intended to recover your actual financial losses. This can cover anything from your past and future loss of earnings to the cost of medical rehabilitation.

Your Special Damages therefore depend entirely on the amount of money you have lost or had to spend or will spend because of the stress at work that you’ve experienced. Financial losses in stress at work claims can be significant, especially if your ability to work is affected, and/or you require care.
