A Cycling Accident Claim Case Study
Our Personal Injury Solicitors successfully dealt with a cycling accident claim on behalf of a CWU postal worker who was injured after the chain on his delivery bike snapped and he was thrown heavily to the ground.
The postal worker was using a Royal Mail bicycle for his round at Fordham, Essex. As he left a delivery address at Mote Road, the bike's chain snapped and he was thrown to the ground.
Landing heavily, he sustained a fractured left shoulder, 20% of which symptoms were deemed to be permanent when he later attended Colchester General Hospital. The postal worker also injured soft tissue in his right knee and was forced to take time off work.
To aid diagnosis, our Personal Injury Solicitors arranged an MRI scan. Instructed by his union, the CWU, we submitted a claim to the Royal Mail Group alleging a failure in its duty of care within the Provision and Use of Work Equipment regulations 1998. This claim was underpinned by a previous legal decision against The Post Office.
Clearly the bicycle's chain had been defective, and was therefore a direct cause of the postal worker's accident.

Liability for the accident was admitted by the defendant and a personal injury settlement was secured for £9,500 compensation.
