“Realising I Would Never Own My Leasehold Home Was Very Upsetting”


Emily, one of our clients, talks about the impact of her increasing ground rent clause and how we helped her resolve the issue and buy her freehold.

As a first-time buyer, Emily felt proud when she bought her leasehold property in Manchester in 2014. But 4 years down the line, she was shocked when she received a request for a payment of over £1,400 for ground rent, and finding out it had increased to over £400 a year.

She thought back to her discussions with her Conveyancer, but didn’t remember them explaining about the ground rent clause and what it would mean for her. The clause meant that Emily’s ground rent would increase over time in line with Retail Price Index (RPI).

Emily requested her case file and realised that her Conveyancer really hadn’t been clear enough about the implications of this ground rent clause.

“After doing some research, I came across the National Leasehold Campaign and ended up going along to one of their roadshows, where Simpson Millar were doing a talk. I ended up getting in touch with them and they picked up my case,” said Emily.

“Helen Hall and Lisa Owen who were assigned to my case really understood my issue, and were very articulate when explaining what the problem was. They helped me understand that I could make a ground rent claim and really talked me through the process and what my Conveyancer should have done.

“At first my Conveyancer was really dismissive and insistent that I had been told everything, as they didn’t want to accept liability. I felt really upset and embarrassed that I didn’t understand the issue. I was worried as I’d put all this money into buying a house, and realising that I would never own it myself was really upsetting."

Emily was awarded £8,500 in compensation which she used to buy the freehold on her house so she could own it outright.

“Helen could have pushed for more, but I just wanted the issue resolved as quickly as possible for a fair amount,” continues Emily.
