Our client, Mr. Bevan, instructed us after suffering an accident at work that resulted in life-changing injuries.
At the time of the accident, Mr. Bevan was carrying out his duties as a Warehouse Operative in the freezer section – he was in the process of checking pallet labels to identify what his colleague needed to move using the forklift truck.
Unfortunately, one of these pallets had been incorrectly placed in a way that meant the label was hidden. Mr. Bevan took a step back to get a better look, not realising his colleague was reversing the forklift truck and he was now directly in its path.
Mr Bevan’s right foot was run over by the truck, and he sustained a crush injury that required partial amputation of his outermost toe. He also suffered associated soft tissue injuries to his right foot in the accident.

How we Helped
We sent a letter of claim to Mr. Bevan’s former employer and informed them that they had acted negligently and had breached their duty of care to employees.
One of the points we pulled upon was the fact that the forklift truck that had been in operation did not have any reversing sensors or a warning alarm. Mr. Bevan’s employer had known that this was the case and had not done anything to rectify it, compromising colleagues’ safety by continuing to have the equipment in use.
We also found that the company did not have an adequate system for inspections and maintenance in place and had failed to segregate work spaces with clear traffic routes for machinery.
As Mr. Bevan’s former employer was responsible for his injuries, we asked them to fund immediate rehabilitation for him under the Rehabilitation Code.
The Outcome
Mr. Bevan’s ex-employer submitted an early offer of £30,000 before we obtained medical reports. We informed Mr. Bevan of the options available to him and after consideration, he chose to accept this initial offer.
We’re pleased with this outcome for Mr. Bevan, which covered the cost of his medical treatment, and we wish him all the best going forward.
