Mr S was operating machinery when the accident happened and he had to spend nearly two years off work. During this time, he made good progress with his recovery, but the fact he was missing a finger meant he struggled with many day-to-day activities. He also complained of phantom limb pains following his accident.
Mr S was very keen to return to work as soon as he was able, but he couldn’t go back to his previous role as the department he worked in had since closed. As a result, he was offered a different role within the same company.

How We Helped
Mr S got in touch with our Serious Injury Solicitors for a free claims assessment and legal advice, as he felt it was his employer’s negligence that led to his accident and the loss of his finger.
Mr S’s employer accepted liability (fault) for the workplace accident, which meant the case wouldn’t have to go to Court. Instead, we had to negotiate with them to ensure a fair compensation settlement reached that truly reflected our clients’ needs.
We obtained medical reports from a consultant plastic surgeon, a consultant psychiatrist and consultant prosthetists, so both the physical and psychological consequences of his accident could be taken into account. We also arranged for him to be examined by an expert who could provide advice and costings for a prosthetic finger that could help him function better both at home and at work.
Melanie and Gulderen also looked at how Mr S’s accident at work had affected him financially. For example, he was unable to work for two years following the accident, and was on statutory sick pay and claiming benefits for much of this time. From this review, they pursued a claim for loss of earnings, and also contacted his pension provider for details of any loss of pension following his accident at work.
With this comprehensive information on his financial situation and his future care and rehabilitation needs, we were able to work out how much compensation he should be awarded.
The Outcome
Following negotiations with Mr S’s employer, we secured a compensation settlement of £90,000.
This amount reflected the trauma of what he had experienced, covered his financial losses, including future loss of earnings, and gives him the means of accessing the care and therapy he will need.
