Morrisons Workers’ Equal Pay Battle – Is Your Wage Fair?

Thousands of staff members at supermarket chain, Morrisons, have won the first round of a legal battle for equal pay.

The Employment Tribunal ruled that female store workers can now legally compare their roles to distribution centre roles after more than 2,300 workers make equal pay claims.

The first step in arguing a case for equal pay is usually to establish which roles are comparable to make sure the wage is fair across the board. This means that the thousands of women making a claim against Morrisons are now one step closer to winning their legal battle for equal pay.

What Happens Next in the Morrisons Legal Battle?

As the Employment Tribunal have found both the retail worker and the warehouse worker roles comparable, the workers have a strong case that the reason for the difference in pay is sex discrimination.

The next steps in the case are for the Judges of the Employment Tribunal to consider whether there is another reason why the two comparable jobs are not being paid the same.

Morrisons argued that the mostly female retail staff and mostly male warehouse staff job roles can’t be compared. But as the Tribunal have ruled in favor of the retail staff, further hearings looking into whether the jobs are equally valuable will go on as well as looking for a reason why the workers’ pay doesn’t reflect this.

How to know if you’re Being Paid Equally

The law states that no matter what gender you are, your employer must treat all staff equally in the terms and conditions of employment if you are employed to:

  • Do ‘like work’, which is work that is the same, or mostly the same
  • Complete work that has been rated as the same during a job evaluation study
  • Do work that is of equal value in effort, skill or decision making

This means that if your employer is treating men and women differently for doing the same job or a job that is equal, you could make an Equal Pay Compensation Claim.

But it can be difficult to know when you’re not being treated equally.

How to Make an Equal Pay Claim

  1. The first step is to ask your employer for information that will help you work out if there is an equal pay issue, and if you think there is you should ask them to explain the reasons for the difference in pay
  2. If you feel they haven’t given a good enough reason, you could raise a formal grievance
  3. If you’re not happy with the outcome of the grievance, you could make a claim before the Employment Tribunal by filling in a Early Conciliation process through ACAS
