Mr W was on holiday with family and friends in Ibiza, celebrating his godson’s wedding. Some of them decided to go on a boat excursion trip to the picturesque island of Formentera.
Mr W and his friend were invited to sit at the front of the boat on a make-shift wooden seat. They were enjoying the boat ride when all of a sudden a large boat passed them, causing a large wave.
The driver of the boat Mr W was on failed to slow down in time, and the force of the boat hitting the wave caused Mr W to be thrown into the air and painfully land onto the wooden plank.
The accident left him with severe bruising, a fractured vertebra and coccyx, and a cut on his arm. The rest of the boat trip was ruined as Mr W was taken to hospital.
Mr W got in touch with our Holiday Accident Claims Solicitors, who are specialists in dealing with all types of holiday accidents, including accidents at sea.
We instructed orthopedic experts to assess the severity of Mr W’s injuries. The experts drafted a medical report, giving their prognosis and opinion on how his injuries may affect his life in the long term.
Because the accident at sea was bound by Spanish law, there was a strict time limit in place for Mr W to make a claim. As the time limit was fast approaching, our Holiday Accident Claims Solicitors contacted our network of Spanish Lawyers to help interrupt this limitation so we could protect Mr W’s position.
We instructed one of the Spanish Lawyers to draft a report, giving a realistic valuation of the claim according to Spanish law. The Lawyer gave his opinion on how much compensation Mr W could claim based on the amount of loss he’d suffered because of his injuries.
After extensive delays with the defendant and their Spanish Lawyers, the case was due to go to Court. But 9 days before the Trial was due to take place, we settled the claim by mutual consent with the defendant. This is quite common as only about 1% of personal injury claims in the UK go to Court.
Thanks to the strength of the medical report and expertise from the Spanish Lawyers we instructed, Mr W secure £55,000 compensation. This reflected the pain and suffering he’d experienced as a result of the boat accident on holiday, and the extra costs he’d had to pay such as medical fees.
