£120,000 Compensation after Motorbike Accident on Holiday

Mr H, an avid motorcycle enthusiast, was enjoying a motorcycling holiday with his wife in Germany. He was riding his motorbike at around 15mph in heavy afternoon traffic, when the driver of a car pulled out from a petrol station and hit his bike.

The collision left Mr H with serious injuries so he was immediately taken to hospital where he underwent immediate surgery.

The accident caused Mr H to suffer from a double dislocation of his foot and a tibial plateau fracture (a break around the upper part of the shin) in his knee. Whilst Mr H had immediate surgery unfortunately, the first operation was unsuccessful and he had to undergo multiple, extensive operations, including a skin graft for an infection caused by his initial operation. The process was long and painful.

Mr H had to stay in hospital in Germany for 7 weeks before being repatriated to the UK for even more surgeries. Understandably, it was very upsetting for Mr H to be away from home for so long.

How We Helped

Mr H got in touch with our Holiday Claims Solicitors for a free claims assessment and legal advice.

Utilising our network of international Lawyers, we contacted a Lawyer in Germany to help him work on Mr H’s motorbike accident claim. Based on his advice, we pursued a direct claim against the car drivers’ insurer, claiming on behalf of both Mr H and his wife, who both lost out on income as a result of the accident.

We requested medical reports from two experts - one expert in assessing orthopedic injuries, to determine the extent of the injuries and give a prognosis, and the other an expert psychiatrist to assess how the accident had affected Mr H’s mental health.

As the Motorbike Accident Claim was bound by German law, we helped the German Lawyer prepare what’s known as a Quantum Report.

A Quantum Report assesses liability (fault) in an accident and the extent of injuries sustained. To help with this, we provided medical reports detailing the nature of Mr H’s lasting injuries and how his injuries would affect him both in the short term and long term.

We then gained further quantum advice from a Barrister and put forward an initial offer for compensation based on Mr H’s instructions.

The Outcome

Because of the Covid-19 pandemic, the Court hearing was postponed. The defendant rejected our original offer and submitted a counter-offer. We went back to Mr H and explained the compensation offer to him, breaking down the costs involved and clarifying the final amount of compensation that he would receive.

Mr H accepted the offer, so there was no need to arrange a new Court date.

Thanks to the strength of the medical evidence and the expertise of the experts we instructed, we helped Mr H secure a compensation settlement of £120,000.
