Greensill Capital Staff Could Claim Up to 90 Days' Pay
If you worked for Greensill Capital (UK) Limited, who also traded as Greensill Capital Management Company (UK) Limited, and you lost your job after the company filed for insolvency, you could claim up to 90 days’ pay by making a Protective Award Claim.
There are two conditions that you have to meet to make a Protective Award claim. They are:
- More than 20 members of staff lost their job in one location
- Your employer did not consult with you properly about your redundancy
Because Greensill Capital went into insolvency so quickly because its backers removed their support after concerns over the company’s asset valuation, they probably didn’t have time to properly consult employees on the redundancies.
You also don’t need a minimum length of service to make a Protective Award claim either.

How to Make a Protective Award
As long as you meet the two conditions mentioned above, you can make a Protective Award claim. You can make a Protective Award claim on your own, or with your colleagues, but you’ll need a Judgment in your favour from an Employment Tribunal.
Before you can take your claim to an Employment Tribunal, you must get permission from the administrators, Grant Thornton, who has been appointed as joint administrators. If our Employment Lawyers take on your Protective Award claim, we’ll take over and get all the relevant permissions for you.
You’ll then need to complete a process called Early Conciliation with ACAS. This is a requirement for all Employment Tribunal claims. This is simply a formality in the case of Protective Awards though, as the main aim of Early Conciliation is to settle a claim before it gets to Tribunal.
How Much Will I Get in a Protective Award Claim?
You can be awarded up to 90 days’ pay when you make a Protective Award claim, but you are guaranteed at least 8 weeks’ pay by HM Government Insolvency Service. There’s a cap of £538 per week and any award will be based on your weekly wage.
The maximum amount you’ll receive for your Protective Award £4,304.
Time Limit to Make a Protective Award Claim
There are strict time limits to make a Protective Award Claim.
You only have 3 months less one day from the date you were made redundant so it’s really important to get specialist legal advice from an Employment Solicitor as soon as possible.
Will it Affect My Holiday or Redundancy Pay?
No it won’t. These payments are completely separate from a Protective Award Claim and making one won’t impact these payments.
