How Do I Make a Protective Award Claim?

You can make a Protective Award Claim yourself or as part of a group claim with your colleagues – this is usually a smoother process for you all.

To make a claim, you must get permission from Green Energy’s administrators. You can then begin the Employment Tribunal process, starting with an Acas Early Conciliation which you must complete before Tribunal.

How Much is a Protective Award?

You can claim up to £4,352 through a Protective Award Claim and there’s a cap of £544 per week. Compensation is based on your gross weekly pay and you can still claim any outstanding wages or holiday pay you’re owed.

Whether you’re a full time or part time employee, you’re guaranteed to get at least 8 weeks’ pay from HM Insolvency Service.

There’s a deadline of 3 months less than one day from the date you found out about your redundancy to make a claim. As this is a fixed time limit, it’s best to get advice from an Employment Law Solicitor as early as possible.
