What is a Protective Award Claim?

A Protective Award Claim is compensation awarded to employees after they were made redundant without proper consultation from their employer.

To be eligible to make a claim, you must meet two criteria:

  • At least 20 of you must have been made redundant at the same location
  • Your employer failed to follow the correct redundancy procedures

How Much Compensation Will I Get?

You could claim up to 90 days’ pay through a Protective Award, with the maximum amount you can claim being £4,352. You’re also guaranteed to get at least 8 weeks’ pay by the HM Insolvency Service.

The amount of compensation you’ll get will be based on your gross weekly pay, and you can make a claim whether you’re a full time or part time employee.

If you’re expecting any holiday pay or outstanding wages, don’t worry – these won’t be affected by a Protective Award Claim.

How Do I Make a Claim?

    2. Get permission from the administrators – you can’t make a claim without this
    3. Attend an ACAS Early Conciliation – this needs to be completed before going to an Employment Tribunal
    4. Get a judgment from the Employment Tribunal – they’ll decide whether your employer failed to consult with you properly about your redundancy
    5. Receive your compensation – this will either be paid to you directly by Genlec Ltd or by the HM Insolvency Service if your company can’t pay

Time Limits for a Protective Award Claim

You only have three months less than one day from the date you were made redundant to make a Protective Award Claim. As Genlec Ltd went into administration on 18th August 2021, this means you have until 18th November 2021 to make a claim.
