What is a Protective Award Claim?
A Protective Award is in place to compensate employees who were made redundant without proper consultation.
But to be eligible to make a claim, you need to meet a set criteria:
- At least 20 members of staff must have been made redundant at the same location
- None of you were consulted properly about your redundancy by your employer
As long as you meet the above criteria, you could very well make a Protective Award Claim.
What is the Claims Process?
Once you’ve used our free eligibility checker, our Employment Law Solicitors can walk you through the process from start to finish.
Usually, it will go like this:
- We’ll contact joint administrator, Eddie Williams, for their permission to make a claim
- We will begin the Acas Early Conciliation process on your behalf – this needs to be done before you can file a claim with the Employment Tribunal
- You will get a judgment from the Employment Tribunal deciding that you were not properly consulted about your redundancy
- Your Protective Award will be paid by HM Insolvency Service

How Much Does a Protective Award Pay?
Protective Awards can pay up to £4,352 with a cap of £544 per week. Your compensation will be based on your gross weekly pay, but you’re guaranteed to get at least 8 weeks’ pay by HM Insolvency Service.
It doesn’t matter how many years you’ve worked at EVCL Chill for or how many hours you work – both full time and part time employees can make a Protective Award Claim as long as they meet the criteria.
Time Limits for a Protective Award Claim
You only have 3 months, less than one day, from the date your employer made you redundant to make a claim. This is a strict time limit so it’s important to get legal advice as soon as you can.
