Is NHS Continuing Healthcare Means Tested?

No. NHS Continuing Healthcare Funding (CHC Funding) is a package of care provided outside of hospital that is arranged and funded solely by the NHS for individuals with significant, ongoing healthcare needs. But unlike social care, CHC Funding is not means tested.

The two organisations responsible for providing care in the UK are the NHS and your Local Authority. Healthcare is provided by the NHS and free of charge. Social care, meanwhile, is provided by your Local Authority and depending on your financial situation, you may have to pay for some or all of it.

An NHS Continuing Healthcare Assessment will determine whether you have a Primary Health Need or require social care. If the majority of your needs are for healthcare, you will be eligible for CHC Funding, regardless of your financial situation.

Difference between Healthcare and Social Care

Healthcare includes treating or controlling an illness, disability or injury. Social care is the assistance with daily tasks such as washing, dressing and eating. It can be difficult to distinguish between the two and there may be some overlap. This means that assessments are often complex and time-consuming. There may also be a dispute as to whether an assessment has been properly carried out.

Our Care Homes Solicitors have specialist expertise in NHS Continuing Healthcare Funding assessments and appeals. We can guide clients through the assessment and/or appeal process, thereby removing much of the stress involved and improving the chance of a successful outcome.

If your needs, or those of your loved one, don’t meet the criteria for NHS Continuing Healthcare Funding (CHC Funding), then we can provide a no obligation consultation and consider issues including your financial situation and the funding options available to you.

Simpson Millar can also advise you on making a Will, Lasting Power of Attorney and severance of joint tenancies.
