Biker Has Vital Rehabilitation and Surgery after Road Accident

We helped a keen motorcyclist get the treatment and rehabilitation he needed after being seriously injured in a road traffic accident.

David* was riding his motorcycle with a pillion passenger in the outside lane of the M6 when a car veered across the carriageway directly across his path.

The car hit his bike and he was thrown a considerable distance off his bike, and he was left with significant and life-changing injuries, including significant fractures to his lower right leg, hip and lower back.

What Happened after the Accident?

Before the accident, David had been a keen motorcycle enthusiast, but could no longer ride. He was also a keen walker who undertook several charity walks, including the Three Peaks challenge, and was keen on keeping fit and healthy.

But David’s injuries were so severe that he needed a huge amount of care and assistance following the accident. This mainly came from his wife, who had to give up her job to give him the care he needed.

His injuries also meant he couldn’t return to work, and he was left with significant psychological problems, including travel-related anxiety and an increase in pre-existing PTSD symptoms.

The driver pleaded guilty to driving without due care and attention, but didn’t admit liability (fault) for the accident.

How We Helped

David approached our specialist Motorcycle Accident Solicitors for help, and I agreed to help him claim compensation. This would help him recover any financial losses he’d experienced because of the accident, such as loss of earnings, and give him the means to access any specialist treatment and rehabilitation he needed.

We arranged for David to be assessed by various medical experts, including an Orthopaedic Surgeon, a Pain Management Specialist, a Neurologist, an Occupational Therapist and a Psychiatrist.

Each specialist prepared reports outlining his condition, which helped us identify what type of care and support he needed.

Interim Payments Pay For Therapy and Home Adaptations

We managed to arrange for David to receive several interim payments of compensation, so he could access rehabilitation including physiotherapy and hydrotherapy before the case was fully settled.

The interim payments also helped with adaptations to his accommodation. He had a downstairs wet room with shower installed, the back garden was modified to make it more accessible, as was his driveway.

But since liability hadn’t been admitted, Court proceedings had to be issued.

Eventually, the driver’s insurance company did admit fault, and we secured further interim payments for David.

Using the evidence that we’d obtained, we worked out how much compensation he should claim. This reflected factors such as the severity of injuries, the cost of the care and rehabilitation he would need, his loss of income since the accident and his potential future loss of earnings.

Final Settlement Agreed

Following negotiations with the other side, a compensation settlement of £685,000 was agreed.

This settlement meant he could get the treatment that was recommended to him by our independent experts, including surgery on his right foot and hip that will help improve his mobility and independence.
