A Cycling Accident Claim Case Study – Client Situation
We were contacted by the mother of a man in his mid-40s who was killed in cycling accident. The man was cycling home from work when he was hit by a car and sadly died from his injuries.
The driver of the car didn’t stop at the scene of the accident, neither did he report the accident to his insurers. However, our Road Traffic Accident Investigations team tracked down the driver. Some time later, the police traced the driver of the car and he was found guilty of causing death by dangerous driving.

The mother of the man who died decided to claim compensation for the accident, as the loss of her son had a life changing effect on her life. He'd been living with his mother, paying her board and helping her considerably around the house as she is elderly.
The man’s mother contacted our Road Traffic Accident Solicitors for a free consultation and legal advice. Personal Injury Solicitor Sinead Ducrotoy, who specialises in cycling accident claims, took on the case.
After assessing her situation, Sinead was confident there were strong grounds for claiming compensation, as our client’s son had provided both practical and financial support before he was killed.
Sinead and her team arranged and obtained a report from an Occupational Therapist which set out all the care our client needed, which included but wasn’t limited to:
- Providing meals and drinks
- Washing clothes
- Carrying out home maintenance
Sinead contacted the car driver’s insurers and advised them that had her son not died, he would’ve continued to provide this much-needed support to our client for the rest of her life. But, the defendant insurer tried to argue that he would not have continued to look after our client for the rest of her life and would not have continued to live with her.
Despite the defendant insurer’s view that our client's son wouldn’t have continued living and caring for her for the rest of her life, we successfully negotiated a compensation settlement of £90,000 for our client.
This would cover the cost of her care and assistance for her remaining lifetime, and also reflected the emotional distress of suddenly losing her son and primary carer.
We are now acting for the children of the man who died in their claim for dependency. During the course of the claim, we traced his children as they had become estranged.
