Mrs B was in her mid-70s when she was walking along the pavement and tripped and fell on a wobbly paving slab.

Mrs B felt immediate pain to her hip and wrist and so had to be taken to hospital in an ambulance. She was diagnosed as having suffered a distal radius (leading up to the thumb) fracture in her right wrist and a subcapital (compression) fracture of the right hip. 

Her elbow was in a cast for 6 weeks, which weakened her wrist. Thankfully, she didn’t feel much pain after her cast was removed. However, due to her age, her wrist may never strengthen and she is also at risk of osteoarthritis (the wearing down of the cartilage that cushions the bones in our joints).

The worst part of the accident was the damage Mrs B suffered to her hip. She had to have surgery on her hip the day after the accident which meant staying in hospital for 10 days and led to her becoming immobile for 6 weeks. After these 6 weeks, Mrs B still had to use crutches to get around and was in significant pain.

13 months later Mrs B was in so much pain that she had a total hip replacement, which then took even longer to recover from.

This had a huge negative impact on Mrs B’s life as she was unable to go about her daily tasks, such as walking the dog, household chores, DIY and gardening. Her husband had to take over all of the chores whilst also spending hours caring for his wife.

How We Helped

Mrs B contacted our Personal Injury Solicitors for a free consultation and legal advice on how she could claim compensation for her accident. She spoke with Gulderen Salih, one of our Personal Injury Lawyers, who has over 20 years of experience and specialises in serious injuries.

After speaking to Mrs B and her husband about the accident, Gulderen made a claim on Mrs B’s behalf for the damages for personal injury sustained during her accident. Gulderen requested a medical report and gained expert medical advice in order to support the claim.

The trip and fall accident left Mrs B unable to do her pre-accident activities, like cleaning the house, walking the dog, looking after her garden, shopping or driving. She uses crutches at all times when she leaves the house and a walking stick around the house. Mrs B also needed help washing, dressing and getting in and out of the bath and so her husband had to care for his wife in this way, as well as take on all of the daily chores alone.

This resulted in Mr and Mrs B having to hire a cleaner, window cleaner and a less regular gardener to cater to some of these tasks that were normally shared between them. This meant that there were extra charges that Mrs B would not normally spend before her accident and so Gulderen helped them to claim these expenses back in the claim for compensation.

Mrs B also had to attend regular hospital appointments following her accident, to which her husband drove her, for further surgery and also rehabilitation.

The Outcome  

Mrs B was awarded a total of £53,500 in compensation. This helped to cover the cost of care and assistance that Mrs B needed following her accident, including that provided by her husband, as well as cleaners and gardeners.

This compensation also covered the costs of hospital treatments and travel to and from the hospital, for all surgeries, appointments, and physiotherapy and rehabilitation visits.
