£45,000 Compensation for Council Employee Injured at Work

Mrs. B was working for Blackburn and Darwen Council in July 2018 when she suffered a fall that left her with traumatic injuries to her shoulder.

While walking through a set of double doors in a main corridor, Mrs B was tripped up by a safety cone that was concealed behind one of these doors. Landing heavily on her right shoulder, Mrs B immediately felt intense pain and was taken to hospital where she had surgery for her injuries.

Mrs. B underwent open reduction internal fixation (ORIF) surgery in hospital, a procedure that is only used in cases where bones are severely broken and cannot be fixed with a splint or cast.

Since her accident, Mrs. B has unfortunately experienced ongoing pain and difficulties with her right shoulder and still suffers from limited movement.  

How we Helped

We were instructed on behalf of Mrs. B to seek compensation for her pain, suffering and loss following her accident.

After speaking to Mrs. B, it became clear that her employer had failed in their statutory duty by failing to provide a safe place of work and allowing for hazards to be left in the corridor that ultimately led up to this foreseeable and preventable accident.

To get a clearer picture of the extent of Mrs. B’s injuries and the impact they would have on her life, we arranged for her to be seen by a Consultant Orthopaedic Surgeon who confirmed our concerns that the long-term effects of Mrs. B’s injuries would impact her ability to return to work.

Mrs. B continued to struggle with lifting items at or above shoulder height and because of this, she was only able to go back to work on a phased three hour per day basis. Even on these reduced hours, Mrs. B found that her shoulder was aching towards the end of each day.

We also referred Mrs. B to be seen by a Consultant Plastic and Hand Surgeon. He highlighted Mrs. B’s scarring following her surgery and justified a potential need for cosmetic camouflage to avoid her feeling self-conscious in future.   

We considered the cost of past and future treatment in Mrs. B’s claim as well as her loss of earnings and the impact of her injuries on her ability to carry out both work-related and domestic tasks.

The Outcome

We were able to secure a settlement of £45,000 for Mrs. B which she accepted, this will help with her ongoing recovery as well as providing financial security for the future.
