Our client, Mrs Thomas was staying at a hotel in Gran Canaria when she fell on a poorly maintained bridge spanning the hotel’s swimming pool. She sustained a broken hip in the fall, and subsequently contacted our Holiday Claims Solicitors for free legal advice about claiming compensation.

How We Helped

Mrs Thomas’ holiday accident claim was taken on by our Head of Travel Law and Holiday Claims Nick Harris.

Nick worked with a Spanish abogado (Lawyer) and an architect in the Canaries to prove that the swimming pool bridge which resulted in our client’s injuries, fell well below the safety and maintenance standards expected in Spain and the Canary Islands.

The lighting at the time of Mrs Thomas' accident was also poor, making it difficult for her to make her way safely across the bridge. While English Law applied to her case because she had booked a package holiday, it was Spanish and Canarian standards of safety that we had to measure.

The Outcome

Mrs Thomas was awarded a compensation settlement of £27,000 which reflected the severity of her injuries and the impact they had on her life.

Speaking after the compensation settlement was agreed, Mrs Thomas said, "The service was efficient, professional and sensitive to the nature of my claim. It was an excellent service with good communication.

"Mr Harris was considerate, understanding and extremely helpful. He was a patient and caring gentleman, making me feel valued. The service was exceptional and exceeded my expectations. I can see nothing that might improve what is offered.”
