A Pedestrian Accident Claim Case Study – Client Situation
We helped a man in his 50s claim compensation after he was hit by a Mercedes car while out jogging.
While on his run, our client ran across a zebra crossing. However, a speeding driver failed to notice him going over the crossing and react to his presence.
As a result, there was a collision, and our client was thrown a distance and briefly lost consciousness. He sustained a number of injuries in the accident, including a head injury, multiple fractures to his leg, finger and nose, and soft tissue lacerations to his left leg and left shoulder.
The accident had physical and psychological consequences for our client, including scarring.

Following a free consultation, Solicitor Simon Stanfield, our Head of Road Traffic Accidents agreed to take on his case, as he believed the man had a strong claim for compensation.
Simon arranged for our client to undergo a medical assessment from a Consultant Orthopaedic Surgeon, who prepared a medical report detailing the extent of his injuries and future treatment he may need.
An aesthetic nurse practitioner also carried out an assessment of our client and wrote a report on his resultant scarring and recommended treatment.
This meant we had a wide-ranging body of medical evidence to present as part of our claim and value it appropriately.
Simon also examined the financial consequences of the accident, as our client had incurred various expenses following the accident, including travel and medication costs.
In addition, our client required care and assistance from his family after of the accident. This was considered to be over and above what would normally have been given in the ordinary course of family life, and again, was factored into our estimate of how much his claim was worth.
Simon approached the car driver’s insurer with details of the pedestrian accident claim including our estimate of how much compensation we believed he was entitled to. Simon argued our client was entitled to compensation because the driver of the car had been driving without due care and attention.
For instance, the driver had failed to apply the brakes in time or at all, drove too fast in all of the circumstances, didn’t keep an adequate stopping distance, failed to see our client on the zebra crossing and react to his presence.
Following negotiations with the car driver’s insurer, Simon secured £25,000 compensation for our client. The compensation compensates him for his injuries and losses and enables him to move on with his life.
