£25,000 Compensation for Pedestrian hit by a Motorcycle

Our client was crossing a road in Bolton when a motorcycle struck her shopping trolley and drove over her right leg.

This caused fractures to her leg and back. She had to undergo surgery, involving the insertion of a metal implant, and subsequent physiotherapy for the leg injury. Her spinal fracture was treated using a brace for three months during which she was in severe pain. After several months her leg injury improved but her back injury continued to cause her pain, especially when standing up for prolonged periods.

How we helped

We arranged a medical examination for our client, in order to assist with the claim. In addition to the main injuries, Professor Sochart found that our client also experienced intermittent sleep disturbance, due to back pain, her ability to cook was restricted (due to being unable to stand for long periods) and she had to have carers attending her home twice a day in order to help her in and out of bed. It was found that after a period of six months our client should not have any further problems though as a direct result of the accident.

We used recent case outcomes in our submissions to suggest a suitable compensation amount.  The Motorcyclists Insurance Company, Aviva, admitted liability for the accident. In our claim we were also able to include a request for compensation for converting the clients existing bathroom into a wet room, care and assistance requirements and a cancelled holiday to India.

The Outcome

Our client received a settlement of £25,000, part of which was used for adaptations to her home which she needed as a result of the injuries.
