A Cycling Accident Abroad - Client Situation

Mr J was enjoying a holiday in Cantoria, Almeria in Spain with his friends. They were cycling around the city when a car collided with Mr J, causing him to be thrown onto the car windshield before falling onto the road.

The crash left Mr J with several cuts and bruises and a deep wound to his knee, as well as damage to his hip, pelvis and back.

To make matters worse, the driver of the car carried on driving without stopping to check that Mr J was okay. The driver had also been driving on the wrong side of the road at the time of the accident, while Mr J and his friends were cycling single file on the correct side.

Mr J was rushed to a local hospital where his knee had to be repaired with 23 staples. He also had to use crutches to get about for 2 weeks afterwards.

Back in the UK, Mr J began to experience increasing discomfort in his right groin and hip, and an MRI scan showed that he’d sustained a fracture to the right side of his head. He was also suffering with disturbed sleep, repeated flashbacks to the accident and memory loss.

How We Helped

Mr J got in touch with our Holiday Claims team who specialise in road accident abroad claims. After a free consultation and an initial assessment of his claim, we were able to take his case on and we began to gather evidence to establish liability (who was at fault).

At first this cycling accident claim proved a bit tricky, as all we had to work with was a Spanish Police report which only included a witness statement from the defendant driver.

Fortunately, the driver of the car admitted liability, but because they didn’t have insurance, we pursued a claim through the Motor Insurance Bureau (MIB).

As we’ve got a strong international network of Lawyers, we got in touch with an expert in Spanish law who drafted a compliant report valuing the claim. He provided us with an accurate amount of compensation that Mr J could expect based on Spanish law.

We also got in contact with an Orthopaedic Specialist and a Consultant Neurologist to get their opinion on the severity of Mr J’s injuries.

The medical experts examined Mr J’s injuries and reported that he had sustained an osteochondral fracture to the right femoral head and permanent scarring to his knee. The reports also highlighted the psychological side effects Mr J was experiencing and how his injuries were interfering with his day-to-day life.

The Outcome

The case was due to go to Court, but due to the overwhelming strength of the medical evidence and expertise of the experts we consulted, we succeeded in settling the claim before the case reached Court.

Mr J was awarded £14,350 compensation for:
