Public bodies can sometimes act unfairly and unlawfully, some common examples are:
- If relevant factors aren’t considered in their decision-making.
- Consultations aren’t undertaken with an open mind about what the outcome might be.
- Bias being shown during the decision-making process.
Decisions made by a public body may also be challenged if irrelevant factors are considered or it can be argued that a decision wasn’t rational.
If a decision does appear to be unfair, we’ll seek to find a way to ensure that it’s not allowed to stand. But be aware that there are often very strict and short time limits for action in these types of cases.
