Injuries and Recovery
The woman, who cannot be named for legal reasons, was in her 60’s at the time of the collision which left her with significant injuries, including a severe traumatic brain injury, a fractured skull and multiple orthopaedic injuries.
She was admitted to intensive care and then the neurosurgical high dependency unit for urgent treatment, before spending several weeks in a rehabilitation ward at Salford Royal Hospital..
However, despite the efforts of her medical team she suffered ongoing problems with her cognition and memory, in addition to post-traumatic epilepsy, which made it difficult for her to live independently.
She was no longer able to work or manage her property and affairs, and she was moved to a residential care home.
Legal Proceedings and Settlement
Following the crash her family instructed personal injury law experts at Simpson Millar Solicitors to bring a claim for compensation against the driver securing interim payments and final funding that would properly fund her ongoing care, accommodation and rehabilitation costs.
Crucially, the family also wanted to have the means to bring her back to her own home that meant everything to her.
Their legal team from Simpson Millar’s Manchester office, alleged that the driver had been driving at excessive speed, and that they had failed to take sufficient and reasonable care and caution in an area where speed was limited to 20mph.
A police investigation later took place, although no charges were brought against the driver.
Family’s Reaction and Lawyer’s Statement
Commenting on the outcome of the case her family said they were happy and relieved to have secured justice on her behalf, and to have the funds needed to provide the care and support she needs to be able to live at home.
