Conveyancing Procedure - Update
The Law Society is consulting on how the residential conveyancing process could be improved in England and Wales.
The consultation paper named "Improving Residential Conveyancing" aims to seek practitioners' views on revised conveyancing protocol, e-conveyancing and the new HM Land Registry portal.
The proposals include:
- Moving towards full seller disclosure and relying on the doctrine of caveat emptor – let the buyer beware
- Provision by the buyer of a completion ready pack
- A Residential Conveyancing Accreditation Scheme
- Residential property solicitors taking on a role similar to that of a French notary
