If the advice you need does not fall into one of our fixed fee packages, please get in touch and we will look at the advice you need, and provide you with our best estimate as to the overall costs involved, right from the outset. That way there are no surprises.

DECLARATION OF TRUSTS

Advice on preparing a declaration of trust on buying a property with another person


You should consider a declaration of trust if you are buying a property with another person. It is imperative to agree and record how you wish to purchase and own the property: either as Joint Tenants or Tenants in Common. Both types of joint ownership have very different legal and financial consequences.

COURT OF PROTECTION

Advice on deputyship applications


If your loved one has lost the capacity to make their own decisions, then you may need to apply to become their financial deputy. We are experts in the Court of Protection field and even if the help you need is not necessarily a supported application, we would encourage you to get in touch with us so you can see how we can help.

  • Arranging for a GP or consultant to undertake a mental capacity assessment
  • Completing the application and supplemental forms regarding the protected person and the proposed deputy
  • Advice on fee exemptions and remissions. Arranging these where appropriate

LASTING POWER OF ATTORNEY (LPA)

Advice on setting up lasting power of attorneys

To avoid storing up problems for the future, we recommend a one stop LPA service which includes both the preparation and registration of Lasting Powers of Attorney with the Office of the Public Guardian.

There are 2 types of Lasting Power of Attorney (LPA) which allow you to give someone else control over your future:

  • Health & Welfare: gives power to the attorney to make decisions about the donor’s healthcare and personal welfare. The power to make these decisions can only be taken if the donor lacks mental capacity, and
  • Property & Finance: gives power to the attorney to make decisions about and control the donor’s property and financial affairs eg bank accounts and savings.

Estate administration services

Estate Administration Service

Dealing with a death estate can often be complicated, especially at what is often a very challenging time. Our solicitors have a great deal of experience in this area and can provide as much or as little support as you may need. Every estate is different, which is why we offer a range of services to make sure you can choose the service you need in your particular circumstances and at the right price. We also offer the following fixed fee options for probate work, if the help you need is limited or straightforward.

Probate: Grant Only: Price: £960

What's included:

  • Telephone consultation explaining the process involved
  • Where there is no Will, acting on behalf of surviving spouse/civil partner or adult children to obtain Grant
  • Where there is a valid will, acting on behalf of the executors appointed in the Will
  • Completion of the short form Inheritance Tax return (IHT 205)
  • Drafting Oath in support of application for Grant
  • Obtaining the Grant of Probate or Grant of Letters of Administration and appropriate number of court sealed copies

Probate: Small Estates: Price: £3,000

Our Small Estates service is right for you if:

  • you want us to deal with the whole estate administration
  • the net estate is worth less than £325,000
  • there are no more than five beneficiaries, AND
  • there are no more than 10 institutions/providers who we need to deal with (in terms of assets and liabilities)

What's Included:

  • Intestate estates (where there is no will) but where there is a surviving spouse and/or adult children
  • Collecting in information on the value of the estate
  • Arranging payment of funeral costs
  • Checking and putting in place house insurance, if necessary
  • Liaising with all utility companies, council tax, TV licence, creditors, store card and club memberships
  • Short form inheritance tax return
  • Obtaining the grant of probate or grant of letters of administration
  • Collecting in assets, payment of known debts and liabilities
  • Advice relating to advertising for unknown creditors
  • Reclaim of income tax (only if the deceased was not a self-assessed tax payer)
  • Payment of all monetary gifts
  • Finalising any estate income tax and capital gains with HMRC
  • Preparation of a Final Estate Account
  • Distribution of the estate between the beneficiaries and obtaining receipt for payment

  • We will expect to invoice you monthly and for you to discharge your invoices promptly
  • A payment on account may be required
  • All disbursements including court fees must be paid up front as you go along
