Our client a postman was delivering mail to a property which he had to accessed by walking along a fire escape. The fire escape was unsafe because it was covered with roof felt which had bubbled and come away. He lost his footing on the felt covered steel steps and struck his head when he fell, needing 9 stitches to close his wound.
Simpson Millar LLP were instructed to bring a claim against the owner of the property but at first they refused to cooperate and neither he nor his insurers were willing to accept fault for the accident. Once we issued court proceedings, we received an out-of-court settlement offer of £2,000 which was accepted.
The client said ‘the service was excellent’.
