If your child is starting primary or transferring into secondary education in September 2022, your Local Authority must legally issue you an amended EHCP naming the school they will attend by 15th February 2022.

Local Authorities may fail to meet this deadline. If they miss it, you may be able to challenge this failure by Judicial Review. A Judicial Review Pre-Action letter to the Local Authority is usually enough to make sure that a final, amended EHCP is issued without further delay.

We're the largest Education Law team in the country, and we have specialist Education Law Solicitors with years of experience in these types of cases. Not only can we assist in securing the EHCP in the first place, our team can also assist with a challenge against the contents of the EHCP if needed. This can include a challenge against the named school. We understand that lodging an appeal can be complicated, but you can rest assured we have the right experience to make a difference to you and your family.

From my very first phone call the game changed for me — emotionally and strategically — with regard to the sleepless nights (literally) I had been experiencing for months as we faced the County Council to secure funding for our son. A feeling of despair and overwhelm was replaced with a sense of competence and empowerment. With Simpson Millar's coaching, we were able to secure the support our son needed with minimal hassle. Two years later, our son is thriving. I will always be grateful to Imogen and her team

"The advice and support provided by Mr Dan Rosenburg and his colleagues was excellent. His willingness to not only provide balanced and pragmatic advice, but also consider and revise his opinion when appropriately challenged, was refreshing and appreciated. In particular his sensible consideration of the wider picture and clear communication of the likely outcomes of certain litigation choices has undoubtedly saved us considerable amount of future stress."

  1. Parents Win Extra Support for Their Daughters Needs

The use of Applied Behavior Analysis (ABA) can divide opinions but Simpson Millar’s Education Law team have been instructed in many cases where there has been evidence of its success. Just one example of this is when we acted for the parents of a six-year-old girl who we will refer to as J.
