So what’s different about American Law?
There are 50 states in the USA and each one has slightly different laws. There are some major differences which mean a specialist solicitor is needed:
- Unlike the UK, there is no legal requirement for unlimited motor insurance
- Compensation is decided by juries rather than by judges
- Cases are funded differently to the conditional fee agreement – you still pay nothing if you lose, but pay a percentage of your compensation
- Some claims are handled in the Federal (national courts) and others are handled by the State courts
There are also other laws that apply for accidents on cruise ships and aircraft. Also, if you find yourself injured on land controlled by a Native American Reservation, you may find your claim being subject to the laws of a tribal court!
