Will New Whiplash Rules Shake up the "Compensation Culture"?

Under new Ministry of Justice reforms, only the evidence of accredited professionals will be considered in a claim for whiplash compensation.

Clamp Down on Compensation Culture

Chris Grayling, the Justice Secretary, has vowed to 'drive out' the "compensation culture" by introducing a number new measures designed to lower motor insurance premiums for drivers.

Mr Grayling said the clamp down on false whiplash claims will help "hard working people by tackling high insurance premiums and other motoring costs".

Although the number of people claiming compensation for whiplash from a car accident has gone down, almost half a million claims still went ahead in 2012. The Association of Personal Injury Lawyers has welcomed medical experts being involved in the process of whiplash claims, especially when they are being used as a tool to battle fraud in the industry.

A lot of insurance companies have a habit of making people offers of compensation before any medical evidence has been obtained. Susan Vanden, partner and Head of the RTA Department at Simpson Millar LLP views this type of behaviour as actively promoting fraudulent claims. Because of this, genuine claims have a high risk of being under settled with many not getting the compensation they deserve.

Honest Victims Still Protected

Having medical expert evidence involved in the claims process will also help gain compensation for those who are honest victims of whiplash. £2.35 billion is the estimated amount that victims are losing out on every year in damages.

The UK has a reputation of being the whiplash capital of Europe and the government is hoping to shake off that status and make the system more robust.

Although there is a lot to be said for the "compensation culture", there is still a considerable amount of people that suffer genuine whiplash from a road accident. If this has happened to you and you are suffering from the symptoms of whiplash, then you should make a compensation claim.

As a firm, Simpson Millar LLP has dealt with whiplash claims at all levels ranging from smaller claims to those with a compensation settlement of £855,000. If your injuries are affecting your life and you need help seeking compensation, we have a lot of experience in this area.
