The Diffuse Mesothelioma Scheme – Helping You Claim Compensation
Knowing which employer to claim against when you've been diagnosed with asbestos related cancer is often one of the hardest jobs your solicitor will have to undertake. Mesothelioma and other asbestos related cancers
can take up to 30-40 years to show signs after exposure.
The New Scheme
Previously, if you could not contact your previous employers or their employer liability insurance company, in legal terms your case would have come to an end. Now, with the new Diffuse Mesothelioma scheme coming into force on July 1st
, you will be able to continue with your claim.
£350 million will come from insurers over the next decade to help the victims of asbestos exposure that has led to cancer
. This has been in the pipeline for months as the government realised it is an ongoing problem for victims of the disease.
One of the disadvantages of the scheme is that it only applies to those diagnosed with mesothelioma after the 25th of July 2012
. Campaigners want the qualifying date set back so more people can take advantage of the scheme. For those that can use the scheme, there are 2 steps you'll have to follow if you want to make a claim and you could not find your previous employers
or their insurers.
How Do I Use the Scheme?
Firstly, you will have to submit a form to the administrators proving that you were exposed to the asbestos during your employment
and this was due to your employer's negligence. Examples of this could be not receiving proper training
to deal with asbestos or not being given the proper equipment or clothing
to deal with it. Following on from this, you will have to show that you have made a real effort to try to find your employer's insurers without any success. The timescale for a decision on your application is around 6 weeks
No one would dispute that the Diffuse Mesothelioma scheme is a step in the right direction
for people who were negligently exposed to asbestos by their previous employer. It will certainly help those who have recently been diagnosed or are living with the condition.
