School Guilty of Unfairly Dismissing Staff & Failing to Consult


On 10 August 2010, in the middle of the school holidays, Bodiam Manor School in East Sussex closed without warning and all staff were dismissed. There was no notice of the closure and staff were not informed or consulted about possible dismissal.

Affected staff, including GMB member Margaret Fryatt, subsequently brought Employment Tribunal proceedings arising out of the closure. The Employment Tribunal, sitting at Ashford, has now formally confirmed that the claimants were unfairly dismissed. They also held that the School were in breach of the collective consultation requirements in cases of mass redundancy.

Damningly, the Employment Tribunal held that the School took no steps to inform or consult the claimants or their representatives about possible closure and that there had been a complete lack of compliance with the collective consultation provisions.
