Malignant Mesothelioma claim results in £350,000 compensation
We originally acted on behalf of a gentleman who was suffering from malignant mesothelioma
. He sadly passed away whilst we were working on his claim, so we continued acting for his widow. It was believed that our client's Mesothelioma illness was caused by exposure to asbestos
during his employment.
There were two potential defendants, one of which was in the process of becoming a dissolved company
. As companies need to be active for a claim to be made against them, we made an application to defer the dissolution
of the first defendant company.
We obtained specialist medical evidence during the course of the industrial disease claim
No admittance of breach of duty was made but we were able to argue that judgement should be entered against one of the defendants at a Show Cause Hearing
. Our client received an initial interim payment of £50,000
We were then able to finalise the settlement in the sum of £350,000 which was awarded to the widow
following the death of her husband to a work-related fatal illness claim.
