The Law Of… Protecting Privacy

10 separate claims from ex-pupils of Clifton College School have been settled by Edwin Buckett who was instructed by Phillip Gower, Personal Injury Partner at Simpson Millar.

The claims were made against Clifton College School where the ex-teacher and housemaster of the school had covertly filmed the students between the years of 1997 and 2014. The teacher was prosecuted and imprisoned in 2015 for filming the pupils.

Edwin Buckett and Phillip Gower successfully settled claims for breach of confidence, invasion of privacy and the right to private and family life, under Article 8 of the European Convention of Human Rights (ECHR).

Phillip comments:

"These cases are important and recognise a right to privacy and the ability to claim damages for any invasion of privacy and breach of confidence, in circumstances when it is not necessary to prove that personal injury has been sustained."
