Child abuse claims – compensation at last
A City Lawyer is suing the Catholic Church for negligence, following Child Abuse experienced more than 30 years ago.
Despite the length of time since the acts complained of, the death of the perpetrator and the closure of the school the Claimant attended, in a recent landmark judgment, the Law lords have permitted the claim to proceed.
This case follows the House of Lords ruling last year in favour of the victim of a sexual attack who was able to bring a claim against her attacker after years of delay. There had been a material change in the attacker’s circumstances when he won the lottery while serving time in prison.
The courts are increasingly sympathetic to the claims of child abuse victims, long after the event who often remain silent through denial, shame and trauma at the treatment they received.
Lawyers and Insurers predict a steady rise in these claims.
