£4,000 compensation for case of Salmonella on holiday at Bellevue Park Hotel, Tunisia

We were recently instructed by a client who had become ill whilst on holiday in Tunisia, who on her return to the UK, was diagnosed with Salmonella.

Our client was staying at the Bellevue Park Hotel, Port El Kantaoui in Tunisia. This was a package holiday she had booked through a UK tour operator. Our client reported that the food at the hotel was not properly cooked and that the staff hygiene standards were poor. Towards the end of the holiday our client began suffering from watery diarrhoea, nausea, fatigue and flu-like symptoms and following tests performed by her GP she was diagnosed with Salmonella food poisoning. On her return to the UK she had to take time off work due to her illness.

A claim for compensation was brought against the tour operator who made an early settlement offer which our client initially wanted to accept. However it was advised by us that the she should refuse the offer as it was only a fraction of what she could receive. This was due to the fact that the client would have to pay back the money her employers paid to her when she was off sick out of the settlement, and that the current offer would not cover this cost.

After gathering further evidence a higher counter-offer was put to the defendant, which was accepted at £4,000.
