£3,000 compensation awarded for road traffic accident

Dated:

We were recently approached by a client who had been involved in a road traffic accident in 2008.

Road Traffic Accident

The client had acted on his own behalf allowing the defendant to instruct a medical expert of their choice. The client was unhappy with the evidence of the medical expert and therefore instructed Simpson Millar to act.

We were instructed 6 months prior to limitation and therefore had to act fast. We liaised with the clients union seeking protection against legal fees. We also sought alternative independent advice and resolved the case by 3 years post accident.

Susan Vanden, Head of our Road Traffic Accident team said: "Under the Limitation Act, personal injury claims need to be presented to the court within 3 years of knowledge of the loss, in road traffic accidents this is invariably 3 years from the date of the accident."

"There was evidence which undermined the claimants case from the original medical expert therefore it was a rather tricky negotiation."

"It is important that specialist legal advice is sought early on to ensure that the injured claimant is properly represented from the outset."
