£3,000 awarded for accident in car park


Our client approached Simpson Millar to assist in making a claim for personal injury compensation.

Our client was disabled and parked her car in a disabled spot in the defendant’s car park. To get to the shop, our client had to cross a raised kerb edge. As this kerb was unmarked our client tripped and sustained injury.

The defendant denied liability stating that the kerb had been there for some time therefore it was not possible to be held as dangerous.

However, the defendant had, since the accident, adapted the kerb edge by painting it yellow so attention could be brought to it. Since this adaptation had been made it was possible to convince the defendant that it was in fact a dangerous area for disabled visitors.

The defendant subsequently agreed to pay compensation to our client in the sum of £3,000.
