As of Thursday 24th February 2022 at 5pm, we cannot take on any more ex Beaumont Morgan Development employees to help with their protective award claims.

You may want to pursue this without our legal assistance. If so, please contact ACAS on 0300 123 1100 or visit www.acas.org.uk for advice.

Please kindly note that Simpson Millar LLP cannot be held responsible in the event that you seek to bring a claim after the limitation period has expired and you should seek independent legal advice if in doubt about when your limitation period is.

You can also get in touch with our Employment Team for free initial advice.

Are There any Time Limits?

You have 3 months less one day to make a Protective Award Claim.

If you’re eligible for Protective Award compensation, we’ll help you at every stage of your claim, so you don’t miss this deadline.

It may also be worth reaching out to your colleagues to see if you can make a group claim as this can often speed up the process.

What is the Process?

Our expert team can handle the entire Protective Awards Claim process for you, so you don’t need to worry about filling out paperwork or hitting deadlines.

We can help you make your Protective Awards Claim in these five steps:

Step 1: Use our free eligibility checker to see if you’re eligible for a Protective Award Claim.

Step 2: If you’re eligible, we’ll get permission from the administrators to make your Protective Award Claim.

Step 3: Next, we’ll complete an Early Conciliation with ACAS (a standard exercise that needs to be done before we can go to an Employment Tribunal).

Step 4: We’ll then file your claim with the Employment Tribunal. They will consider all the evidence and make their judgment.

Step 5: If the Employment Tribunal passes judgment in your favour, we can claim your Protective Award compensation from the company, or the Insolvency Service.

How much compensation can I get from a Protective Award Claim?

You could get up to 90 days’ worth of pay, the amount of compensation you’ll receive will usually depend on your gross weekly wage.

If your compensation is paid by the Insolvency Service, there’s a cap of £544 a week for up to 8 weeks. This means the maximum amount you could claim would be £4,352.

You’ll get paid for all your outstanding holidays and you’ll also get redundancy pay too because these are separate from a Protective Award Claim.

Who can Claim?

Both full time and part-time staff can submit Protective Award Claims, but you will need to have been an employee at the company. We’re unfortunately not able to help people who are self-employed or were contractors for the business.

There’s no minimum length of service that you need to have worked to be eligible.
