Taylor Bloxham Staff Can Claim Up to 90 Days' Pay

If you worked at Taylor Bloxham in Leicester and you lost your job after the company went into administration, you could claim up to 90 days’ pay by making a Protective Award Claim.

There are two conditions that you have to meet to be able to make a Protective Award claim. They are:

  • More than 20 members of staff lost their job in one location
  • Your employer did not consult with you properly about your redundancy

As long as more than 20 people were made redundant at Taylor Bloxham and its associated businesses, former staff should meet the first condition of a Protective Award. They also meet the second because the company was forced to close because of cash flow issues. As a result, the company did not have the time to properly consult employees on the redundancies.

Another important point is that you don’t need to have worked for Taylor Bloxham for a minimum length of time to be eligible to make a Protective Award claim.

How to Make a Protective Award

As long as you meet the two conditions mention above, you can make a Protective Award claim. You can do this by getting a Judgment in your favour from an Employment Tribunal. This has to contain either your name or your job title.

You can make a Protective Award claim on your own, or make it along with your colleagues. That would mean that you would all be included on the Judgment and could make a Protective Award claim.

Before you can take your claim to an Employment Tribunal, you must get permission from the administrators to do this. If our Employment Lawyers take on your Protective Award claim, we can take over and get all the relevant permissions for you.

You’ll also need to complete a process called Early Conciliation with ACAS. This is a requirement for all Employment Tribunal claims. This is simply a formality in the case of Protective Awards though, as the main aim of Early Conciliation is to settle a claim before it gets to Tribunal.

How Much Will I Get in a Protective Award Claim?

You can claim up to 90 days’ pay when you make a Protective Award claim, but you are guaranteed at least 8 weeks’ pay. There is a cap on the amount of pay you will receive and the award is also based on your weekly wage. The maximum amount you’ll receive for your Protective Award is £525 per week.

This money is paid out by HM Government Insolvency Service, so you don’t need to be concerned about taking more money out of the already failing business.
