Protective Award Process

There are some steps you will need to go through to make a Protective Award claim. They are:

Get Permission from the Administrators

Get Everyone Involved

When you make a Protective Award claim, you can do this alone or as a group of employees made redundant. It makes sense for you all to come together and make the claim together. Because you need a Judgment from an Employment Tribunal with either your name or your job title included on it to make a claim, it makes sense for all former employees to get together and make a claim. After all, you’re all in the same situation.

Complete Early Conciliation

Early Conciliation is a process that was put in place to help to resolve claims before they go to an Employment Tribunal. Settling the claim in these circumstances is not possible, but this process with ACAS still needs to be completed. It is just a formality in the context of a Protective Award claim and should be signed off quickly.

Get a Judgment

Once the Early Conciliation process has been completed, your Protective Award claim will go to an Employment Tribunal and a Judge will decide if they want to make the award. As long as the criteria above it met, there are very few reasons why the Judgment would not be made in your favour.

Once you have a Judgment, you can claim your Protective Award.

How Much Will I Get?

The law says you can claim up to 90 days’ pay. Your Protective Award will be paid out by the Insolvency Service and they guarantee payment of 8 weeks’ pay. They do place a cap on the amount they will pay out, and it’s capped at £525 per week. The award you are given is based on your weekly wage and the maximum will be £4,200.
