What Can I Claim Compensation For?

Each individual case is different, so we can’t put an exact figure on how much compensation you’re likely to get until we’ve looked into your specific claim. Usually, you’ll be compensated for:

  • The pain, suffering and trauma you’ve experienced
  • How much of your holiday was spoiled by the accident
  • Loss of holiday enjoyment
  • Any loss of earnings
  • Medical costs and out-of-pocket expenses
  • The cost of rehabilitation support you need
  • Care and assistance expenses
  • Home modifications if the accident caused a disability

Who Can I Claim Compensation From?

If you booked a package holiday through a tour operator based in the UK, then they are responsible for:

  • An accident in the hotel or resort you’re staying in e.g. slipping on a wet floor
  • An accident while on a trip or excursion booked through the tour operator
  • A car accident whilst driving a rented car, or while on a coach transfer booked by the tour operator
  • An accident on an airline or cruise ship

For accidents that happen on a cruise ship or aeroplane, you could claim against the cruise ship operator or the airline. But the law surrounding these types of claims can get complicated, so it’s best to get legal advice from a specialist Holiday Claims Solicitor. How Long Does a Claim Take?

If you’re a UK resident, you have three years from the date of your holiday accident in which to make a claim. But this time limit can vary depending on the local law of the country where the accident took place.
