Cartwright Group Staff Could Claim Up to £4,304 in Protective Award

Staff at Cartwright Group were told today that the company had fallen into administration today, with 480 staff being made redundant.

Cartwright Group, a commercial trailer manufacturer, had sites in Altrincham, Glasgow, Leeds and Aldridge and staff at these sites could make a Protective Award claim of up to 8 weeks’ pay.

To make a Protective Award Claim, you must:

  • Have worked at a site with at least 20 people who were made redundant and
  • Not gone through the correct redundancy consultation process

Why Should I Make A Protective Award Claim?

Losing your job is hard to take, particularly during these extremely tough times. When making multiple redundancies, employers have a number of rules and regulations they must follow by law. Once they make redundancies due to being in administration, they’ve usually not followed the right procedures to make them and this allows you to make a Protective Award Claim.

What is a Protective Award?

It’s a payment made, usually by the Insolvency Service, to staff who’ve lost their jobs through redundancy when a company is in administration. There are a number of steps to the process of making a Protective Award Claim.

Step 1 – Check if You Can Claim ­– this is easy to do. Just use our Eligibility Checker or call one of our Employment Solicitors.

Step 2 – Get Your Colleagues Involved – as long as your team mates and colleagues meet the criteria above, they can also make a Protective Award claim. Get as many of them together with you to make a joint claim.

Step 3 – Get Permission from Administrators – you’ll need to get permission from the administrators, Deloitte, to make a Protective Award Claim. If we take on your claim for you, we’ll do this.

Step 4 – Prepare Paperwork for Employment Tribunal – to make a Protective Award claim, you will need to get a judgment from an Employment Tribunal. We’ll prepare all the paperwork for you and get you through the Early Conciliation process with ACAS. This is a requirement for all Employment Tribunal claims, but in your case, just a formality.

Step 5 – Get a Judgment from and Employment Tribunal – a Judge will decide whether Cartwright Group did not consult properly or not. The judgment, if in your favour will mean you can make a claim. Anyone whose job title or name is included on the judgment can make a Protective Award Claim.

Step 6 – Make your Protective Award Claim – once this process is completed, you can make your Protective Award claim.

How Much Will I Get?

You can claim up to 8 weeks’ pay and your Protective Award amount will be based on your weekly wage. There is a cap of £538 per week, so your total award could be £4,304.
